Cruelty / क्रूरपणा

 क्रूरतेच्या संकल्पनेत मानसिक तसेच शारीरिक क्रौर्याचा समावेश आहे. शारीरिक क्रौर्य म्हणजे जेव्हा एक जोडीदार दुसऱ्या जोडीदाराला मारहाण करतो किंवा दुसर्‍या जोडीदारास शारीरिक दुखापत करतो.  परंतु जोडीदाराबरोबर इतर कुटुंबावरही मानसिक छळ होऊ शकतो म्हणून मानसिक क्रौर्याची संकल्पना जोडली गेली.  मानसिक क्रौर्य हे दयाळूतेचा अभाव आहे जे एखाद्या व्यक्तीच्या आरोग्यावर विपरित परिणाम करते. तसेच शारीरिक क्रौर्याचे स्वरूप निश्चित करणे सोपे आहे परंतु मानसिक क्रौर्याबद्दल सांगणे कठीण आहे

 पत्नीकडून पतीविरूद्ध मानसिक क्रौर्य म्हणून काय मानले जाते:

 

० आपल्या  कुटुंबिय आणि मित्रांसमोर पतीचा अपमान करणे.

० पतीच्या संमतीशिवाय गर्भधारणा संपुष्टात आणणे.

० पती त्याच्या कुटुंबावर खोटे आरोप करणे.

० वैध कारणाशिवाय शारीरिक संबंधास नकार.

० पत्नीचे प्रेमसंबंध आहे.

० पत्नी अनैतिक जीवन जगते.

० पैशाची सतत मागणी.

० पत्नीची आक्रमक आणि अनियंत्रित वागणूक.

० पती पालक आणि कुटुंबावर आजारपण.

पतीकडुन पत्नी विरूद्ध मानसिक क्रौर्य म्हणून काय मानले जाते:

 ० व्यभिचाराचा खोटा आरोप.

 ० हुंडा मागणी.

 ० नवरा नपुंसकत्व.

 ० मुलाचा गर्भपात करण्यास भाग पाडणे.

 ० नवर्याच्या मद्यधुंदपणाची समस्या.

 ० पतीचे अनैतिक संबंध .

 ० पतीची आक्रमक आणि अनियंत्रित वागणूक.

 ०  कुटुंब आणि मित्रांसमोर पत्नीचा अपमान करणे

 

० बलराम प्रजापती विरूद्ध सुशीला बाई

 या प्रकरणात याचिकाकर्त्याने मानसिक क्रौर्याच्या कारणावरून पत्नीविरोधात घटस्फोटाची याचिका दाखल केली.  त्याने हे सिद्ध केले की त्याची पत्नी आणि त्याचे आईवडील यांच्याशी वागणे आक्रमक आणि अनियंत्रित होते आणि बर्‍याच वेळा तिने पतीविरूद्ध खोटी तक्रार दाखल केली.  कोर्टाने ही याचिका स्वीकारली आणि क्रौर्याच्या कारणावरून घटस्फोट मंजूर केला.

Cruelty

 The concept of cruelty includes mental as well as physical cruelty. Physical cruelty is when one mate beats the other mate or inflicts bodily harm on the other mate. But the concept of mental cruelty was added as it can lead to mental abuse on the other family as well as the spouse. Mental cruelty is a lack of kindness that adversely affects a person's health. It is also easy to determine the nature of physical cruelty but difficult to describe mental cruelty

 What is considered as mental cruelty against the husband by the wife:

 

0 Insulting husband in front of your family and friends.

0 Termination of pregnancy without the consent of the husband.

0 Husband making false allegations against his family.

0 Denial of sexual intercourse without a valid reason.

0 wife has a love affair.

0 Wife lives an immoral life.

0 Constant demand for money.

0 Aggressive and uncontrolled behavior of wife.

0 Illness on husband, parents and family.

What is considered as mental cruelty against the wife by the husband:

 0 False accusation of adultery.

 0 dowry demand.

 0 Navara impotence.

 Forcing a child to have an abortion.

 0 Husband's problem of alcoholism.

 0 Immoral relationship of husband.

 0 Husband's aggressive and uncontrollable behavior.

 0 Insulting wife in front of family and friends

 In this case the petitioner filed a divorce petition against the wife on the grounds of mental cruelty. He proved that his treatment of his wife and his parents was aggressive and uncontrollable, and that she often made false accusations against him. The court granted the petition and granted a divorce on the grounds of Cruelty
